InmoBuyer partner programme terms

1. Purpose

The partner programme allows a professional (estate agency, law firm, broker, installation service or any other business in contact with buyers) to make InmoBuyer known to their clients and to receive a commission when one of them takes out a subscription.

The partner sells nothing on behalf of InmoBuyer, receives no payment from the client, and has no volume commitment.

2. Becoming a partner

Registration is online. It requires:

  • the company name and a contact;
  • an email address;
  • the country;
  • the tax identification number;
  • the full billing address.

The tax number and billing address are needed to draw up the commission invoice. Without them, no commission can be paid.

The partner has a partner account, created with that same email address. It is through this account that they access their space: statements, attributed clients, commissions due.

On registration, they receive a personal code and a QR code leading to InmoBuyer and carrying that code. The code works from the moment it is created.

3. Right to commission and validation

The code works from registration, but the right to commission is subject to validation by InmoBuyer. This validation targets registrations whose activity is unrelated to buying property in Spain. There are two routes:

  • Immediate validation where registration is made through a QR code handed over in person at an identified event. That QR carries a token which serves as proof of context and expires on a date set for each event.
  • Validation by review in all other cases. Until it is granted, the code attributes clients but no commission is due.

A refusal is notified. It does not prevent the partner from continuing to use the service.

4. How a client is attributed to a partner

A client is attributed to the partner when they arrive at InmoBuyer through that partner's link or QR code and then take out a paid subscription.

  • The attribution is recorded on the visitor's browser for 30 days, and that period restarts each time the link is used again. A visitor who discovers the service, thinks it over, then comes back through the same link stays attributed.
  • Before any subscription, it is the last link used that counts. A visitor who came through two partners in succession is attributed to the second.
  • After the first paid subscription, the attribution is definitive. A link scanned later does not transfer it to another partner.

5. What is due

15% of the amount excluding tax actually paid by the client, on each invoice paid, for as long as that client remains subscribed. The commission is limited neither to the first payment nor to a fixed period: it follows the subscription.

  • It is calculated on the amount excluding tax actually received, after any discounts. VAT charged to the subscriber is not part of the base.
  • It is recorded when the invoice is paid. One invoice gives rise to one commission only.
  • The 15% rate is the one in force at the date of the invoice concerned.

No exclusivity is required, and no target conditions the commission. A partner who brings nobody owes nothing and loses nothing.

6. The cases where nothing is due

Three situations, and they are the only ones:

  • Self-referral. A partner receives no commission on their own subscription.
  • A partner withdrawn from the programme. Withdrawal stops the production of new commissions; those already earned remain due.
  • An expired attribution. If the subscription happens more than 30 days after the link was last used, no commission is due.

6.1 A client's refund

A client has a 14-day right of withdrawal on their subscription. If they exercise it, they are refunded pro rata to the unused portion, in accordance with applicable law.

A commission only becomes invoiceable once that 14-day period has elapsed. It is earned as soon as the client pays and appears immediately on the partner's statement, but it can only be carried onto an invoice after the subscriber's right of withdrawal has expired. The amount still within that period remains displayed; it is neither lost nor withheld.

This period is the safeguard of the arrangement, and it protects both parties. A subscription cancelled within fourteen days will have given rise to no payment, and therefore to no claw-back to operate.

The commission recorded on a refunded payment is clawed back in the same proportion, as a negative amount on the statement. That claw-back is set off against subsequent commissions.

InmoBuyer does not claim from the partner any negative balance below 100 EUR, assessed per currency. Such a balance stays on the statement, is set off against future commissions, and lapses at the end of the partnership without any demand. Above that amount, InmoBuyer reserves the right to ask for repayment.

7. Invoicing and payment

The partner can consult at any time, in their space, the detail of what is due to them: attributed clients, invoices concerned, amounts.

7.1 The 100 EUR threshold

A commission invoice is only drawn up from 100 EUR excluding tax. Below that, the amount is not lost: it is carried over to the following month, and added to the next, until the threshold is reached. The threshold is assessed per currency.

7.2 Self-billing

InmoBuyer draws up the commission invoice in the name and on behalf of the partner. The partner has no document to produce or send: they only provide the invoice number to be assigned, consistent with their own numbering.

By accepting these terms, the partner gives InmoBuyer a mandate to draw up these invoices in their name, and undertakes to:

  • provide an invoice number for each statement to be settled;
  • report any error within fifteen days of the invoice being made available in their space;
  • inform InmoBuyer without delay of any change of tax number, billing address or VAT regime.

Failing any challenge within that period, the invoice is deemed accepted.

7.3 Payment

InmoBuyer pays by bank transfer within fifteen days of the invoice date.

Payment is made in euros, whatever the currency of the beneficiary account. Exchange and transfer fees are borne by the beneficiary.

No commission can be paid before these terms have been accepted.

7.4 Tax treatment

The treatment depends on the partner's country of establishment, and it is stated on the invoice.

  • Partner established in Spain: the commission bears Spanish IVA at the standard rate. That amount is added to the commission and paid with it. It is passed on in the partner's name, who declares and remits it like any other revenue of their activity.
  • Within the European Union, outside Spain: the intra-Community regime applies and no Spanish VAT is charged. The partner must hold a valid intra-Community VAT number and provide it.
  • Outside the European Union: no Spanish VAT is charged, and the partner is responsible for the declarations incumbent on them in their own country.

8. The optional free Premium access

The partner may request, without obligation, free Premium access on their own account: 40 listing imports and 30 analyses per 30-day period, with no bank card and no subscription. The first 30 days include full Investor access, after which the account settles on partner Premium. The market scanner and the renovation estimator are not included beyond that period; the estimator remains available per unit, at the public price, as for any Premium account.

That access, and it alone, comes with a target: at least 1 subscribed client per month, and 20 over the year. After 3 consecutive months without a single client, the free access may be withdrawn. Withdrawal is never automatic: it is subject to review, and the partner is informed.

Withdrawal of the free access removes neither the code, nor the clients already attributed, nor the commissions. Not requesting this access changes nothing else: the partner earns the same 15%.

9. Withdrawal and termination

The partner may leave the programme at any time, and the preferred route is their partner space: the "Notices and withdrawal" section carries a withdrawal button, which asks them to retype their code to confirm. The effect is immediate.

An email to admin@inmobuyer.com remains possible and has exactly the same effect; the withdrawal is then confirmed in writing. The same address serves to correct their details or to request erasure of their data.

Their attributions then stop producing new commissions; nothing is deleted, and commissions already earned remain due.

InmoBuyer may terminate a partner's participation in the event of use manifestly unrelated to the purpose of the programme. The decision is reasoned and notified.

10. Personal data

InmoBuyer keeps the registration details (company, contact, email address, country, tax number, billing address), the code assigned, the client attributions and the commissions.

When these terms are accepted, the date and a truncated IP address are recorded, in order to evidence the acceptance without keeping a precise location.

InmoBuyer does not disclose to the partner the identity of the attributed clients. The partner sees accounts, invoices and amounts, never names.

The partner has the rights of access, rectification and erasure provided for by the European regulation. Requests to admin@inmobuyer.com.

11. Amendment

These terms may change. Any substantive amendment gives rise to a new reference and a new acceptance.

The terms in force are always the last ones accepted. Refusing new terms ends the partnership; in that case, the commissions provided for remain due in full until their term.

12. Language, governing law and dispute resolution

Language of reference

These terms are published in all the languages of the service. The Spanish version is the authoritative one: in the event of any divergence of interpretation between versions, it prevails. The other versions are translations for convenience, and electronic acceptance covers the Spanish text whatever the display language.

Governing law and jurisdiction

These terms are governed exclusively by Spanish law. Only the courts of Málaga, Spain, have jurisdiction over any dispute arising from these terms or from the partner programme.

Mandatory prior conciliation

Before any court action, the parties undertake to seek an amicable settlement. The request for conciliation is sent in writing to admin@inmobuyer.com, and the parties have thirty days from its receipt to reach an agreement. Only once that period has expired, or where conciliation is expressly refused, may an action be brought before the courts designated above.
